| Purpose of the meeting A public hearing on a proposed revision to the Commonwealth of Virginia State Implementation Plan. The proposed revision will consist of amendments to existing regulation provisions affecting the Northern Virginia ozone nonattainment area, Part II of Chapter 20 (9 VAC 5-20-204) and Article 4 (9 VAC 5-40-240 et seq.) of Part II of Chapter 40. The amendments consist of (i) changing the list of nonattainment areas to reflect a designation of "severe" instead of "serious," (ii) changing the applicability threshold for NOX RACT (reasonably available control technology) from 50 tons per year to 25 tons per year, and (iii) providing that an affected source provide the board with a schedule for making a RACT determination and for achieving compliance with the emission standard by November 15, 2005. The Department is seeking comment on the regulation amendments, and on the issue of whether the regulation amendments should be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to the state implementation plan. | |
