Home and Community Based Service Waiver Amendments

Re 56 hour soft cap

I strongly oppose the proposed 56 hour weekly cap on personal care/assistance under the 1915(c) HCBS Waivers.  A blanket cap does not account for the fact that waiver participants have different disabilities, health needs, living situation, schedules and amounts of available unpaid support.

What one person needs in 8 hrs may be very different from what another person needs.  And life is so NOT an "Only 8 hours a Day of Support Needs reality for so many waiver recipients.

I ask that VA, DMAS, State Delegates and Governor Spanberger seriously reconsider this proposal and stand up for the true needs of so many of its disabled citizens.  Families and individualts should not have to navigate an increasingly complex administrative process simply to preserve services that have already been determined to be medically and funtionally necessary.

Service Facilitations Transitioning Into Support Brokers

Regarding the proposed change from Service Facilitator to Support Broker, it is not at all clear how DMAS plans to manage a variety of involved critical aspects.  If all goes through as currently planned how eligibility interruptions, provider exists, staffing shortages, advocady concerns, and large regional caseloads (ie NVA!) be sufficiently handled?

In short these proposed changes and the non-transparency of the process - could be VERY disappointing, scary and negatively impact anyone  - who is currently involved in the Service Facilitation process and in particular those with the highest support needs.
