Workers at Compass Behavioral Group Will Benefit from this
 

Teamsters Local 322 represent behavioral support clinicians at Compass Behavioral Group. They work directly with children with autism. They are bargaining a first contract and the company does not currently guarantee them a single day of paid sick leave.  These workers frequently get coughed and sneezed on and get ill frequently. This law would allow these workers to recover at home instead of having to show up to work sick.

It would be helpful if DOLI could create a Q and A sheet that clarifies the scope of Exemption L. 

L. Employees who are employed and compensated on a fee-for-service basis shall accrue paid sick leave in accordance with regulations adopted by the Commissioner. The Commissioner shall promulgate such regulations, which shall provide for the accrual of paid sick leave for such employees that is consistent with
the provisions of this section.

Compass Behavioral Group has erroneously claimed during bargaining that, since they are a Medicaid Fee-for-Service provider, they would not automatically be required to provide their employees 40 hours of paid sick leave on July 1, 2027 .  Behavioral Support Clinicians at Compass Behavioral Group are being compensated on an hourly basis so it appears though the company is conflating the company being a fee-for-service provider with compensating their workers on a fee-for-service basis. It would be helpful if you could provide this clarification so employees being compensated on an hourly or salaried basis are not improperly denied paid sick leave.
