There is no legal authority authorizing state agencies to adopt this regulation. Regulations can only implement acts of the General Assembly, and there is no bill that the General Assembly has passed that authorizes this action.
The executive does not have the legal power to invent new laws independently through the regulatory process. Such acts are patently unconstitutional and will undoubtedly be struck down by the courts, and do not have the force of law.
Why are we spending public money on such ridiculous, frivolous and pointless exercises as this?
