To amend section 90 which sets out the requirements for prescribing weight-loss drugs to allow nurse practitioners to prescribe without the patient being seen by the physician.
 Agency Plan
 The petition will be published on March 24, 2014 in the Register of Regulations and also posted on the Virginia Regulatory Townhall at www.townhall.virginia.gov to receive public comment ending April 23, 2014. Following receipt of all comments on the petition to amend regulations, the Board will decide whether to make any changes to the regulatory language.  This matter will be on the Board's agenda for its meeting on June 19, 2014.

The Board voted to accept the petition and initiate rulemaking. The amended rule will authorize a nurse practitioner to perform the physical examination, order and evaluate tests and prescribe Schedule III through VI drugs for obesity, provided such authorization is specified in the practice agreement with the patient care team physician with whom she/he has a collaborative arrangement.
