On 2/6/2018 the board requested that this emergency stage be extended until 1/7/2019.

Reason for Extension:
DARS is requesting an extension of this emergency regulation. The 2016 Acts of Assembly, Chapter 567, enactment clause #2 directed the Commissioner of DARS to promulgate regulations for the provision of supportive housing for individual receiving auxiliary grants. The emergency regulations were promulgated in January 2017 and are due to expire July 8, 2018. There are draft regulations currently going through the standard regulatory process to replace the emergency regulations. These regulations also incorporate language from a separate regulatory action which occurred after the promulgation of the emergency regulations which references the receipt of third party payments. The draft regulations that will replace the emergency regulations incorporate the above-referenced changes. DARS staff is concerned that the existing emergency regulations will expired before the draft regulations replacing them can be promulgated. The draft regulations must go through the Executive Branch review process, incorporate the 60-day public comment period in the proposed stage as well as the additional review processes in the final stages. Moreover, time must be incorporated to account for the publication schedule for the Virginia Register. It is estimated that the soonest the 60-day public comment period would end during the proposed stages is the last week of June of 2018.

This emergency extension request was approved by the Governor's office on 6/15/2018.
