The Code of Virginia does not grant the appeal right to the surviving spouse of a disabled veteran, therefore 1VAC80-10-100 must be amended. Also, the contact information listed in 1VAC80-10-100 is out of date and must be amended. The following applies to this action:
Amend paragraph C of 1VAC80-10-100 to read as follows:
"A veteran desiring to appeal a denial of an application for exemption by a Commissioner of the Revenue or other assessing official shall contact the Commissioner of the Virginia Department of Veterans Services"
In the first line of paragraph E, strike the work "both" and the words "or surviving spouse"
In paragraph F, strike the words "or surviving spouse"
In paragraph H, srike the words "or surviving spouse"
