A LITTLE FREAKING LATE ON NON-DISCRIMINATORY REQUIREMENTS FOR SPECIAL ED
 

Beginning with James Lane at the helm of the Virginia Department of Education and his sidekick Samantha Hollins, Virginia Special Education has taken a turn for the VERY WORST with YEARS of Non-Compliance regarding RIGHTS of Special Education Students being trampled, DENIED, and Families as a 'Routine Matter' being DRAGGED into Truancy Courts and other courts as a matter of routine practice these past years BECAUSE the School Districts AND the Virginia Department of Education have REFUSED to bother to enforce Corrective Actions as REQUIRED and continue this 'nasty' trend, and EXCUSE the OBLIGATION to Provide FAPE due to the fact that SO many families are Dragged through COURT Systems INSTEAD of PROVIDING FAPE.

They WEAPONIZE Attendance Policies EXCLUDING the fact that Disabled Students are 'Disabled' requiring by definition for most, that they have far more MD appointments, therapies, hospitalizations, etc. etc. than Non-Disabled Students, and in CLEAR VIOLATION of the 504/ADA and Rehabilitation Acts REQUIRING Accommodations for EQUAL Opportunity in Public Education, for any entity accepting and receiving Federal Taxes.

What RESTITUTION will Virginia Department of Education make to the HUNDREDS of Special Education Children and Families who have been DEPRIVED their Rights with NO Remedy all these years....Defamed, and dragged through the mud because School Districts illegally unenrolled children and VDOE did absolutely NOTHING regarding it's OVERSIGHT Obligations to PROTECT the Children? 

8VAC20-720-220 Management of the student's scholastic record in the public schools of Virginia

Local education agencies shall manage the scholastic records of all students in compliance with applicable law, including the Family Educational Rights and Privacy Act of 1974 (20 USC § 1232g, 34 CFR 99); the Individuals with Disabilities Education Act (20 USC §§ 1400-1485, 34 CFR 300); and §§ 2.2-3800 through 2.2-3809, 16.1-260, 16.1-305.1, 16.1-305.2, 22.1-3.1, 22.1-270, 22.1-271.2, 22.1-287, 22.1-287.01, 22.1-287.1, 22.1-288, 22.1-288.2, 22.1-289, 32.1-36.1, and 42.1-76 through 42.1-90.1 of the Code of Virginia.
