RE: 11VAC20-30-90. Operation of poker tournaments; administration of poker tournaments.

Subsection N of this section states that, “During a poker tournament held by a qualified organization, no gambling or gaming may take place other than that specifically authorized by this chapter.” As this chapter only specifically authorizes poker, it could be interpreted as to prohibit all other legal forms of gaming during a poker tournament. This seems to contradict the language in 11VAC20-30-100 which permits activities authorized by the Charitable Gaming Law and other specified forms of legal gaming during poker tournaments. I would suggest adding language similar to that used in 11VAC20-30-100 to 11VAC20-30-90 to make it clear that charitable gaming and the other specified forms of legal gaming are permitted to be operated during poker tournaments.
