Guidance Document Change: The 2019 General Assembly passed House Bill 1753, amending Section 22.1-138 of the Code of Virginia regarding the use and operation of electronic room partitions. This is a new requirement to provide safety notice and information about the operation of movable partitions both in schools where new partitions are being installed, as well as during the operation of existing partitions already installed in schools. This measure is to ensure the safety of students during the operation of the movable partitions.

Definition of applicable partitions
 

Please define the type of partition this legislation is intended to cover. Specifically, although motorized roll-up gym divider curtains could be considered an electronic room partition, they come down to the floor softly and pose no risk of injury.

Please define partition types
 

Does this apply to roll up gym dividers? While they are electric they operate slowly and pose no threat unless the "threat" is the partition falling while in motion. There is no "stacking" at floor level.

Electric Gym Divider Curtains pose dangers to students and staff
 

I have personally been called to several electric gym divider accidents, the most recent in Chicago . A 15 year old girl was playing hockey in the gym at jones prep College High school , the puck got caught in the curtain as it started rolling up from the floor. Her arm became trapped  , she was rolled up like a hotdog 25 feet in the air until she could be rescued by the fire dept.  This could have easily resulted in her being suffocated or falling to her death.

Two incidents happened in NJ several years ago involving electric curtains, I was on site at both of these locations as well. One curtain detached from the brackets as it was being retracted up to the ceiling, missing the operator and students in gym class by only inches. This curtain was over 25 feet long weighing hundreds of pounds, this too could have caused serious injury or death to multiple occupants.

 Another incident which I evaluated after being called to , was a 12 year old young man having his sweatshirt hood caught in the gym curtain as it was retracting into the ceiling ,If this student was not able to wiggle out and jump to safety, he could have been hung.

I am also aware of a young lady being trapped under the bar of the electric curtain as it came down from the ceiling, her gym class all helped lift the several hundred pound steele  pipe as she was pulled to safety.

Electric Gym Divider Curtain Issues
 

I have been called to numerous school locations regarding safety issues with Electric Divider Curtains. In most situations, students had come into contact with the moving equipment and became entangled in the steel support cables or rolling steel pipe. The vinyl material which make up these massive dividers is very heavy. The drive system is extremely powerful in order to raise the entire unit overhead.

In most of my experiences, students that came into contact with the operating equipment were lifted off the gym floor (up to 10 feet) before they fell free. In one event, a female student was wrapped up, rolled into the ceiling and rescued by the Fire Department. (google Jones Prep HS Chicago - divider curtain accident)

I have seen first hand and heard stories of students "riding the curtains" during operation in several school gymnasiums. I also had a phys ed teacher jokingly tell me of his students "playing limbo" as the curtains were being raised and lowered. 

In ALL events, individuals which were operating the equipment were unaware of the dangers associated with electrically operated divider curtains. Annual staff training is vital to Staff and Student Safety. Installing safety sensors has proven to be an effective method to protect students. 

Everyone knows that accidents happen and we can all agree on student safety.
