General Information
Action Summary This action amends the Regulations of the Auctioneers Board to conform to changes resulting from the enactment of Chapter 772 of the 2026 Acts of Assembly. The legislation permits regulatory boards under the Department of Professional and Occupational Regulation (“DPOR”) to take disciplinary cases under advisement as provided for in § 54.1-201 A 7 of the Code of Virginia. The legislation also amends the enabling statute of the Auctioneers Board (“the Board”) to reference §§ 54.1-201 and 54.1-202 of the Code of Virginia, which provide for (i) the general powers and duties of DPOR regulatory boards; and (ii) the power of DPOR regulatory boards to impose monetary penalties. This action amends the applicable section of the regulation pertaining to the Board’s authority to impose regulatory discipline to (i) provide that the Board may take disciplinary cases under advisement in lieu of other disciplinary sanctions as provided for in § 54.1-201 A 7 of the Code of Virginia; and (ii) clearly specify that the Board may impose the following sanctions against a credential held by a regulant: • Fine; • Suspension of license; • Probation; • Failing to renew a license; or • Revocation of license.

Executive Branch Review This Action is exempt from Article 2 of the Administrative Process Act. The normal executive branch review process is not required. As such, it can be submitted directly for publication and is effective upon publication.
