CHAPTER 15
DELEGATION OF DUTIES (REPEALED)
24VAC30-15-10. General Provisions. (Repealed.)
A. The Code of Virginia empowers the commissioner of the
Virginia Department of Transportation to delegate certain duties to the Chief
Engineer, Deputy Commissioner, and Assistant Commissioner as circumstances so
require.
B. Duties delegated to the Chief Engineer. The Commissioner
has delegated the following duties to the Chief Engineer:
1. The execution of the necessary certificates or other
instruments to effectively comply with the statutes enacted granting the
commissioner the authority to exercise the power of eminent domain and acquire
rights-of-way, after the commissioner's approval right-of-way plans.
2. The execution of certificates of deposit and all other
instruments contemplated by §§ 33.1-119 through 33.1-129 of the Code of
Virginia.
3. The execution of all contracts or agreements pertaining
to the Chief Engineer's areas of specific responsibility:
a. Highway design;
b. Right-of-way;
c. Construction;
d. Maintenance;
e. Traffic engineering;
f. Structure and bridge;
g. Equipment;
h. Environmental planning and administration; and
i. Materials.
4. This includes, but is not limited to:
a. Contracts for construction and maintenance projects;
b. Agreements for joint highway/railway projects with
railroads; and
c. Agreements with the Federal Highway Administration.
C. Duties delegated to the Deputy Commissioner. The
commissioner has delegated the following duties to the Deputy Commissioner:
1. All acts of the commissioner necessary to discontinue or
abandon roads in the Secondary System of State Highways as contemplated by
Chapter 1, Article II, Title 33.1 (§§ 33.1-25 through 33.1-47.1) of the Code of
Virginia.
2. The execution of all contracts or agreements pertaining
to the Deputy Commissioner's areas of specific responsibility:
a. Highway and transportation planning;
b. Project programming and scheduling;
c. Financial planning; and
d. General administration of the department.
3. This includes, but is not limited to:
a. Agreements for highway projects within cities and towns;
b. Agreements with the Federal Highway Administration;
c. Agreements with the Urban Mass Transportation
Administration;
d. Agreements with the Federal Railroad Administration; and
e. Agreements with local governments, transportation
planning commissions, and other parties eligible for transit and planning
financial assistance.
D. Duties delegated to the Assistant Commissioner for
Administration. The commissioner has delegated the following duties to the
Assistant Commissioner:
1. The development and issuance of appropriate policy on
organizational memberships within the department;
2. The development of appropriate procedures to monitor
adherence to the policy; and
3. The maintenance of a record on organizational
memberships.
