11VAC5-41-250  Public disclosure of winners' names and information

A. Subject to the provisions of § 58.1-4029 of the Code of Virginia, the agency may, with prior written consent of the winner, publicly disclose a winner's name and the city, town, or county in which a winner lives, as well as the prizes won, for public information purposes and to foster the integrity of the games in the following circumstances:

1. If the amount of the prize is less than $1 million, in which case the written consent of the winner is not required; and

2. If the amount of the prize is $1 million or greater, provided the agency obtains the prior written consent of the winner.

B. For prizes in any amount, tThe agency may use the winner's photograph for the purposes set forth in this section, provided the agency obtains the prior written consent of the winner.

C. No consideration shall be paid by the agency to a winner for the use of a winner's photograph and information as described in this section.
