This general notice opens a public comment forum for 22VAC40-705, Child Protective Services. Regulatory action is necessary to implement the requirements of chapters 585, 845, 900 and 865 of the 2026 Acts of Assembly. The language directs the State Board of Social Services to promulgate regulations to implement the provisions of the legislation. The Board’s initial adoption of regulations is exempt from the Administrative Process Act (§§ 2.2-4000 et seq. of the Code of Virginia). In the case of chapters 865 and 900 requiring local departments of social services to respond to valid complaints alleging suspected abuse or neglect of a child under the age of three, opportunity for public comment must be provided prior to adoption. The State Board of Social Services will adopt the regulation at the August 17, 2026 meeting.
