| Purpose of the meeting To approve the regulation for initiation of the final stage of the standard process for permanent adoption. The emergency extension request was granted by the Governor on September 24, 2018, to extend the emergency regulation currently in effect until May 12, 2019 (or until the permanent regulation becomes effective). However, there is a requirement that the final regulation be filed no sooner than 15 days after the close of the proposed stage public comment period (see the last box under Stage 2 of this flowchart). The October 3rd State Board meeting missed that timeframe by three days. When the final stage is filed, there must be another 30-day public comment period. In order to be adopted before the emergency expires and because of the Register’s publication schedule (a two-week delay), the absolute latest date the final peer regulation must be approved through the Executive Branch review in time to file with the Registrar is by noon on March 13, 2019. It would then publish on April 1, 2019, with an announcement of the public comment period, for an expected final effective date on May 1, 2019. This timeframe warrants a special called meeting of the Board to allow as much time as possible for the final Executive Branch review, particularly given the holidays and the General Assembly session in the midst of the review period. | |||
