On 5/19/2015 the board requested that this
emergency stage be extended until 12/30/2015.
Reason for Extension:
DMAS is requesting this emergency regulation be extended until 12/30/2015 for the following reason. This emergency regulation is due to expire June 30, 2015. This extension is required in order for DMAS to continue enforcing the legislative mandate, as set out in the 2013 Acts of the Assembly, Chapter 806, Item 307.III, and the 2014 and 2015 Acts of Assembly, Item 301.BBB to implement appeals updates. As is clear from the Town Hall entry for this project, there have been significant delays in the process of review and certification of this package, which will likely cause the emergency regulations to expire prior to enactment of the final regulations, unless an extension is provided. This package is essential to clarify existing appeals processes and codify emerging processes made urgent by court and administrative case decisions and the increasing volume of appeals generated by provider audits and other utilization review mandates.
This emergency extension request was approved by the Governor's office on 6/24/2015.
