Comments on Regulations Governing Permits for the Archaeological Removal of Human Remains

Thank you for the opportunity to provide comments on this NOIRA stage action.

Regarding 17VAC5-20-40(A)(4) requirement for a statement confirming adequate resources to complete the research design as well as final disposition of the recovered remains; I have no objections to this change at this time.

Regarding 17VAC5-20-50(B) requirement for publication of notices using relevant electronic and social media and other public outlets as well as print newspapers; I do not support this change.  This requirement would exceed the requirements of Code ( 57-38.1) relevant to the disinterment of remains under a court order. The ammended code recommends but does not require notification through electronic media.  I feel that it may be difficult to identify electronic/social media outlets for such notification that are appropriate and agreeable to all parties.  It is my opinion that specific details relevant to the process of public notification should be handled during the application process.

Regarding 17VAC5-20-60(C) removal of gender-specific references to the directorship of the Department; I have no objection to this change at this time.

Regards,

Boyd Sipe, M.A., RPA
