Description |
This regulation ensures that minimum standards for the administration and operation of private prisons are met, and that basic services, programs, and conditions in private prisons are comparable with state facilities. It also provides for administrative regulations governing contract termination, access to the facilities and other agreements regarding the relationship between the Commonwealth and the vendors.

Goals of Regulation |
Goals include ensuring compliance with any statute authorizing contractual arrangements with private entities for the operation of prisons and any contract between a public agency and a private contractor for such operation; to ensure that any contract is cost-effective and provides for proper care, supervision, and treatment of inmates; to provide useful benchmarks for measuring performance by a private contractor to meet minimum recommended guidelines for the maintenance and operation of prisons, as well as meet all federal and state constitutional standards; federal, state, and local laws and court orders; to set the scope of any delegation of the use of force by a private contractor.
