Action Summary |
Currently, the alcoholic beverage regulations are constructed in a manner that limits the ability of wine or beer wholesalers from differentiating pricing between off premises and on premises privilege licensees. In recent years, business practices have changed and it is not uncommon for wine wholesalers in other jurisdictions to create channels for pricing to retailers based on whether the licensee is in business to sell on premise or off premise.
The Alcoholic Beverage Control Board was petitioned by the Virginia Wine Wholesalers Association to consider amending the regulation section 3VAC 5-30-90; Price Discrimination, Inducements, to allow for differentiated pricing between off-premises and on premises accounts. The proposed amendment would only impact the ability of wine wholesalers to establish differentiated pricing between on premise and off premise licensees The ABC Board sought comment on the petition and there was no opposition to moving forward.
