Pursuant to Chapter 372 of the 2025 Regular Session, the Virginia General Assembly expanded the K-12 school policy to require each public elementary or secondary school to develop a cardiac emergency response plan (CERP) or an athletic emergency action plan (EAP), as those terms are defined in the bill, which addresses the appropriate response by school personnel to incidents involving an individual who is experiencing sudden cardiac arrest or a similar life-threatening emergency while on school grounds and, in the event that such school has an athletic department or organized athletic program, while attending or participating in an athletic practice or event. This change revises the Guidelines for Sudden Cardiac Arrest in Student Athletes (2020) to include the requirements of Chapter 372 as one document for schools to use.

The Board for Barbers and Cosmetology (the Board) has reviewed and voted to repeal the following guidance document that is no longer necessary. The guidance previously adopted by the Board is being incorporated into the following final regulations:
- Barbering and Cosmetology Regulations (18 VAC 41-20) and Esthetics Regulations (18VAC 41-70) adopted by the Board on July 21, 2025.
- Tattooing Regulations (18 VAC 41-50) adopted by the Board on September 29, 2025.
- Body-Piercing Regulations (18 VAC 41-60) expected to be adopted by the Board on November 10, 2025.
The repealed guidance is as follows:
1. Guidance Document 5503: Guidance Document - Substantial Equivalence. The guidance provides information for substantial equivalence for training and examination in relation to license endorsement. This guidance is being incorporated into the Board’s final regulations. Repeal of the document will not become effective until the final regulations become effective.

The Real Estate Board (the Board) has reviewed and voted to repeal the following guidance document that is no longer necessary.
The repealed guidance is as follows:
Guidance Document 2021: Real Estate Advisory Council's Report Regarding Post-Licensure Education. The guidance document provides guidance regarding Real Estate Salesperson 30-hour curriculum guidelines. The guidance is no longer necessary because it is being incorporated into the final Virginia Real Estate Board Licensing Regulations expected to be adopted by the Board on December 4, 2025.

The Board for Architects, Professional Engineers, Land Surveyors, Certified Interior Designers, and Landscape Architects (the Board) has reviewed and voted to repeal the following guidance document that is no longer applicable.
The repealed guidance is as follows:
1. Guidance Document 4987: Comity Applicant Criteria of the APELSCIDLA Board's Current Regulations. The purpose of this document is to clarify the application requirements for those persons applying to the Board for licensure or certification via comity based on licensure or certification in a jurisdiction outside of Virginia.
The guidance is no longer applicable because it is incorporated into the final Board for Architects, Professional Engineers, Land Surveyors, Certified Interior Designers, and Landscape Architects Regulations, expected to be adopted by the Board on November 14, 2025.

The Board for Barbers and Cosmetology (the Board) has reviewed and voted to amend the following guidance document.
1. Guidance Document 6373: Barber/Cosmetology Application Review Matrix. The document contains guidance that directs staff to approve certain applications disclosing certain types of criminal convictions or disciplinary actions without sending the application for Board review.
The Board’s existing guidance allows staff to approve applications that disclose the following criminal convictions:
• Felony convictions more than 10 years old with no subsequent reportable convictions of a similar nature, unless the conviction resulted in incarceration where the release date is less than three (3) years from the application date.
• Felony convictions more than five (5) years old with no subsequent reportable convictions of a similar nature, unless the conviction resulting in incarceration and the release date is less than three (3) years from the date of application. Certain felony offenses are excluded, including those for murder, sexual assault, rape, robbery, indecent liberties, and fraud.
• Felony convictions for distribution of a controlled substance, where the applicant has completed a deterrence program if required by the court.
• Misdemeanor convictions.
• Juvenile convictions.
• Drug possession convictions.
The application matrix does not apply to applicants who are currently incarcerated, except those incarcerated for juvenile convictions.
The Board’s existing guidance also allows staff to approve applications that disclose prior disciplinary action only involving monetary penalties that do not involve client safety.
The guidance document will be revised to provide for a delegation of authority to DPOR staff to conduct predetermination fact-findings and license eligibility fact-findings (IFFs) in accordance with applicable portions of the Administrative Process Act (Code of Virginia § 2.2-4000 et. seq.). These delegation of authority provisions are being added to all DPOR regulatory board guidance documents that provide guidance regarding applicants who disclose criminal convictions on an application.
The substance of the guidance regarding staff approval of applications is revised as follows:
• Guidance regarding applications with felony convictions more than 10 years old is removed to reflect changes to the Board’s regulations in which applicants are no longer required to disclose felony convictions more than 10 years old.
• Guidance regarding misdemeanor convictions is removed to reflect changes to the Board’s regulations in which applicants are no longer required to disclose misdemeanor convictions.
• Guidance regarding felony convictions for distribution of a controlled substance is revised to provide that staff may approve such applications for a conviction that is more than two (2) years old. Staff may approve the application for a conviction that is less than two (2) years old if the individual has completed a court-ordered deterrence program.
• Guidance is amended to allow staff to approve applications disclosing driving under the influence convictions.
There are also stylistic changes made throughout the document. This is a result of Executive Order 51. The changes were made from streamlining AI recommendations to help reduce word count, making it easier for consumers to understand and read.

An assessment using the Uniform Assessment Instrument (UAI) is required for all individuals upon admission to an assisted living facility (ALF) and at certain intervals (§ 63.2-1804 of the Code of Virginia). The UAI Manual builds upon regulations found in 22VAC30-110 and provides step-by-step instructions on completing the UAI for local departments of social services (LDSS) and other entities that use it. The Private Pay Assessment Manual builds upon regulations found in 22VAC30-110 and provides guidance to certain staff at private pay ALFs regarding the assessment of individuals applying to reside in or living in an ALF. The Private Pay UAI is an alternate version of the full, UAI and contains only the information necessary to determine whether a private pay individual meets the level of care criteria for residential or assisted living level of care.
The proposed changes to the Private Pay Assessment Manual are clarifying in nature, concerning when an assessment is required and which agency is responsible for relocating private pay residents when necessary. Other updates are grammatical to improve comprehension.
