RE: TRAP

Attorney General Cuccinelli says the VDH and Board of Health never had the right to grandfather or exempt preexisting buildings from having to meet new regulations.  As I'm sure AG Cuccinelli doesn't mean for there to be selective enforcement of the rules, does this mean then that all clinics and hospitals in our state now have to meet the regulations outlined in the 2010 Guidelines for Design and Construction of Health Care Facilities? That would certainly be going against absolutely everything that's been done previous to now, where new regulations would apply only to new structures or renovated buildings. Doing so would definitely put an unfair, almost impossible burden on perfectly safe clinics and hospitals, which in turn would limit access to desperately needed health care and drive up costs. It would probably lead to many of them closing. But no, according to AG Cuccinelli, these laws are only going to be applied to clinics that provide, along with a myriad of important and valuable women's health services, abortions.

It would seem that these regulations and AG Cuccinelli's maneuverings are aimed at a very specific and sole target: abortion clinics, with a very specific agenda in mind: closing them. This is unacceptable. Either all preexisting hospitals and clinics have to meet the 2010 Guidelines for Design and Construction of Health Care Facilities, or none do. There cannot be selective enforcement of the law.
