Proposed regulatory action inadequate; must allow open carry by all
 

The proposed regulation is not consistent with the Attorney General opinion:  http://www.oag.state.va.us/OPINIONS/2008opns/08-043-Cuccinelli.pdf

In order to be consistent with the AG's opinion, the regulation must be changed to allow:  1) concealed carry by concealed handgun permit holders and 2) open carry by any individual who can lawfully possess a firearm, whether or not they have a concealed handgun permit.  In addition, ammunition should not be limited only to "commercial sporting firearms ammunition."

Therefore, 4VAC10-30-170 should be changed to read:

"No person shall bring into or have in any forest any explosive or explosive substance, except firearms ammunition; explosives and explosive substances, except firearms ammunition, are prohibited in any portion of a forest assigned to the Department of Forestry."
