Purpose of the meeting
The Board of Game and Inland Fisheries will meet and hear Department staff’s presentation of hunting and trapping regulatory issues as part of the 2008-2009 Hunting and Trapping Periodic Regulation Review and Amendment Process. The regulatory review is occurring over three Board meetings: October 23, 2008, and February and June 2009. At the October 23 meeting after staff presents regulatory issues the Board will solicit and hear comments from the public. Regulatory issues are a framework to facilitate public discussion of regulatory matters; they are open and susceptible to change, and may be added to, amended, or removed from consideration at any point as deemed appropriate. A public discussion period on regulatory issues will be offered from early November 2008 to early January 2009. At the February 2009 Board meeting, Department staff will present proposal-stage recommendations for hunting and trapping regulatory amendments, the Board will again solicit and hear comments from the public, and the Board will propose regulations or regulation amendments. Any Board-proposed hunting and trapping regulatory actions will then be published in the Virginia Register of Regulations, posted on the internet at www.dgif.virginia.gov, and summaries advertised in newspapers. A public comment period on any proposed regulations will occur from early March to early May 2009. Adoption of any hunting and trapping regulations or regulation amendments as final will take place at the June 2009 Board meeting. Additional information on the regulatory review and amendment process, including information on public meetings, is available on the Department website (www.dgif.virginia.gov). The Board also intends to consider for final adoption new regulation 4VAC15-450. Watercraft: Commercial Parasail Operations, which was proposed by the Board on July 15, 2008, published Virginia Register of Regulations, posted on the internet at www.dgif.virginia.gov, and a summary advertised in newspapers. A public comment period on the proposed regulation opened July 22 and closes October 6, 2008; information on submission of comments is available on the Department website (www.dgif.virginia.gov). At the October 23, 2008 meeting the Board will receive staff's final recommendations regarding the proposed regulation, solicit and receive comments from the public, and it then will determine whether the proposal will be adopted as a final regulation. The Board reserves the right to adopt final regulations that may be more liberal than, or more stringent than, the regulation amendment proposed at the July 15, 2008 meeting, as necessary for the proper management of wildlife resources and boating. The Board is exempted from the Administrative Process Act (§§2.2-4000, et seq. of the Code of Virginia) in promulgating wildlife management regulations by §2.2-4002 of the Code of Virginia. The Board promulgates wildlife management regulations under authority of Article 1 of Chapter 5 of Title 29.1 of the Code of Virginia, promulgates boating regulations under the authority of Article 1 of Chapter 5 of Title 29.1 and § 29.1-701 (E); and publishes all proposed and final regulations as required by § 2.2-4031. The Board will hear a presentation on the Hunting with Hounds Study, and an opportunity for public comment on the presentation will be offered. The Board will receive Committee reports from Finance, Audit and Compliance; Education, Planning, and Outreach; and Wildlife and Boat and will approve the Board Meeting Minutes from the August 19, 2008 Meeting. The Board will approve the 2009 Meeting Schedule for the Board of Game and Inland Fisheries and will receive public comments on non-agenda items. The Board may discuss general and administrative issues and may hold a closed session at sometime during the meeting.
