Overall Impact of Proposed Regulations
The disAbility Law Center of Virginia questions the decision to create these emergency changes. Individuals seeking mental health services already face substantial barriers to access services and these changes appear to create a new set of boundaries and barriers. The regulations establish a much more limited definition of what constitutes a mental illness, purportedly to allow for reimbursement of mental health care. However, the more restrictive definition may lead professionals to over-diagnose, assigning a more restrictive label than is clinically justified.
