Goals of Regulation The purpose of the regulation is to protect children in licensed or registered out-of-home care from persons charged with orb convicted of certain crimes.

The regulation requires a sworn disclosure statement prior to employment and a criminal record report within 21 days of employment for all compensated and voluntary employees, caretakers, and individuals approved by child-placing agencies as foster or adoptive parents. The regulation also requires this information for applicants, their agents, and board members who are involved in the day-to-day operations of a child welfare agency or who are alone with, in control of, or supervising one or more children.

The sworn disclosure statement indicates that the individual has neither a conviction nor pending charges in or outside the Commonwealth of Virginia of those crimes that act as barriers to employment. The criminal record check is conducted to ensure that the person does not have any convictions or barrier crimes in Virginia.
