Mandate Title:
Wastewater Discharge Permits; establishes permitting procedures for treatment facilities discharging less than 40,000 gpd and nutirent trading changes
Purpose of legislation
Establishes procedures for the State Water Control Board (SWCB) to issue a Virginia Pollutant Discharge Elimination System (VPDES) permit for a treatment facility that is proposing to discharge sewage greater than 1,000 gpd but less than 40,000 gpd. A facility treating domestic sewage that has not commenced the discharge of pollutants prior to January 1, 2011, must demonstrate to the SWCB that it has acquired waste load allocations sufficient to offset delivered total nitrogen and delivered total phosphorus loads prior to commencing discharge. Also provides authority for wastewater treatment facilities on the Eastern Shore to acquire nitrogen and phosphorus credits from facilities in the Potomac and Rappahannock tributaries to comply with nutrient waste load allocations. Currently, a permitted facility can acquire point source nitrogen or phosphorus credits only from one or more permitted facilities in the same tributary.
