In order to keep local jurisdictions aligned with VAG regulations, I propose keeping the VDOE in place to oversee local jurisdictions' plans.

Note on identification process being completed within 60 "business days" of receipt of referral: I recommend this language be amended to read within 60 "instructional days" of receipt of referral. The screening process largely takes place on a school level and when school is not in session, screening would not be able to take place efficiently.

If a two-tiered system is in place, it is possible that not all students will receive the same evaluation. All students should be screened using a common system with additional points available (W-J, K-BIT) that might be beneficial to LEP and low-income students who have not had the same back ground as upper middle class students have had.
