| Action Summary |
This action amends the Virginia Real Estate Board Licensing Regulations to conform to changes resulting from the enactment of:
• Chapters 479 and 495 of the 2025 Acts of Assembly
• Chapters 122 and 129 of the 2025 Acts of Assembly
• Chapters 463 and 466 of the 2025 Acts of Assembly
• Chapter 505 of the 2025 Acts of Assembly
The legislation within Chapters 479 and 495 of the 2025 Acts of Assembly amends the definition of “brokerage relationship” and two additional terms were added, “brokerage services” and “showing property.” Additionally, the legislation was amended to clarify how real estate regulants must handle brokerage agreements when representing clients.
The legislation within Chapters 122 and 129 of the 2025 Acts of Assembly amends the statute to eliminate the fee for licensees transferring between branches within the same licensed real estate firm.
The legislation within Chapters 463 and 466 of the 2025 Acts of Assembly amends the statute to expand the activities that unlicensed employees of licensed real estate brokers who manage properties are allowed to perform.
The legislation within Chapter 505 of the 2025 Acts of Assembly amends the statute to no longer permit regulatory boards to deny licenses, certifications, or registrations based on vague or arbitrary terms, such as “good moral character” or “moral turpitude.”
The proposed amendments conform applicable provisions of the regulation to the legislation. |
