A request has been recieved from the Virginia Wine Wholesalers Association requesting that this regulation be amended to permit wine wholesalers to differentiate between on-premises and off-premises licensees in prices charged.

In accordance with Virginia law, the petition has been filed with the Register of Regulations and posted on the Virginia Regulatory Townhall at www.townhall.virginia.gov.  Comment on the petition will be requested until May 20, 2016 and may be posted on the Townhall or sent to the Board. Following receipt of comments on the petition to amend regulations, the matter will be considered by the full Board to determine if there is sufficient need or interest to pursue formal amendment to the current rule.

The Virginia Alcoholic Beverage Board held a public comment period concerning the petition that requested an amendment to the existing pricing regulation.  The petitioner requested that the existing regulation be amended to allow for differences in pricing between off premise and on premise retailers. The Board took public comment on June 22, 2016 .  At this meeting, the Board considered all previously submitted written comments, all of which fully supported the proposal.   The Board decided to proceed with the requested regulatory action.
