Description of Proposed Guidance Document Changes
This guidance supersedes the current Chapter 4 of the DEQ Civil Enforcement Manual (Virginia Regulatory Town Hall ID: CEM-03 and CEM-07). A summary of the changes are as follows: (1) A section was added for natural gas pipelines greater than 36 inches inside diameter to provide civil charge/penalty guidance consistent with recent legislation providing for higher civil charges/penalties if certain criteria are met. A few areas of Chapter 4 were edited to provide appropriate references to the new statutory language. (2) A Local Program Review section was inserted to provide guidance and calculation worksheets for the assessment of civil charges for Chesapeake Bay Preservation Act Program and Erosion and Sediment Control Program reviews.
