This document pertains to DPOR and its operations generally and is not regulatory in nature. This action will make amendments to the following guidance document on Virginia Regulatory Town Hall:
Policy #300-01 – Regulant Name & Address Changes. The policy provides guidance to ensure consistent processing of name and address changes processed by DPOR. The following changes are made to the policy:
a. Formatting of the document is changed.
b. The policy statement is revised to provide that name and address change requests will be recorded in accordance with established licensing and enforcement systems data entry standards and Virginia law.
c. Provisions for requesting a name or address change are revised to provide that requests may be completed using DPOR’s online licensing database.
d. Provisions regarding requesting a name change are revised to clarify that (i) a divorce decree indicating a name change; and (ii) another state’s documentation that provides legal proof of name change are acceptable documentation of a name change.
e. The policy is revised to provide that DPOR Examinations Section personnel who determine that a regulant’s name, main address, or physical address are different from those on record with DPOR must inform the regulant that a written request for the change with required documentation must be submitted to DPOR.

This action will make amendments to the following guidance document on Virginia Regulatory Town Hall:
Policy #300-03: Expedited Licensing of Military Spouses. The policy provides guidance on the expedited processing of applications for military spouses that meet qualifications specified in § 54.1-119 of the Code of Virginia.
The following changes are made to the policy:
a. Formatting of the document is changed.
b. The policy is updated to reflect changes to § 54.1-119 of the Code of Virginia that became effective on July 1, 2020, which provide that the statute applies to applicants whose spouses are the subject of a military transfer to the Commonwealth of Virginia, an adjoining state, or the District of Columbia; or whose spouse retried within one year of the application.
c. The policy is revised to make clarifying references to the Administrative Process Act (§ 2.2-4000 et seq. of the Code of Virginia) regarding regulatory board determinations of substantial equivalency or denial of a license, certificate, or registration.

Policy #800-01: Criminal History and Online Public Records Information. The policy establishes guidelines for requesting and handling criminal history and public records information in compliance with federal and state laws and applicable information system service and security agreements.
The following changes are made to the policy:
a. Formatting of the document is changed.
b. The policy is revised to provide that applicable agency staff, prior to accessing or receiving “Criminal History Information” as defined in the policy, must complete prescribed training identified by entities exercising oversight and control of Criminal History Information (e.g. Virginia State Police.)
c. Provisions regarding the use and destruction of Criminal History Information are revised to provide that upon completion of an investigation, records must be destroyed in accordance with prescribed methods.

Policy #800-02: Filing of Complaints Against Regulants. The policy establishes DPOR guidelines for receiving complaints filed against regulants.
The following changes are made to the policy:
a. Formatting of the document is changed.
b. Provisions of the policy pertaining to exceptions from the requirement that all complaints be in writing are revised as follows:
i. The exemption related to hardship is revised to provide that a hardship be as contemplated by the Americans with Disabilities Act.
ii. The exemption related to life-threatening situations or situations that have resulted in, or have the potential to result in, harm, personal injury or loss to a consumer or the public is revised to provide that life threatening situations or situations that have resulted, or have the potential to result in, physical harm or personal injury to a consumer or the public are exempt from the written complaint requirement.
iii. An exemption for situations resulting in the loss of the consumer’s residence rendering the consumer unable to submit a written complaint has been added.

Farm Market Fresh is a federal nutrition grant program administered by the Virginia Department for Aging and Rehabilitative Services (DARS) Division for Aging Services (DAS). The purpose of the program is to provide fresh fruit and vegetables, and nutrition education to participants, promote farmers’ markets as a direct marketing outlet for Virginia farmers, and promote the sale of Virginia fresh fruit, vegetables and cut herbs. Farm Market Fresh authorizes local farmers to accept Senior and WIC Farmers Market Nutrition Program (S/FMNP) benefits. Last year, this program partnered with 274 farmers and assisted 17,897 older adults and 3,317 WIC recipients. DEQ has incorporated relevant EPA integrated reporting guidance (EPA Guidance) into the Virginia 2026 Water Quality Assessment Guidance. The 2026 assessment guidance is designed to integrate or combine the 305(b) overall assessment of Virginia’s waters and separate out those waters impaired and needing a TMDL as per Section 303(d) of the Clean Water Act. The EPA Guidance and the Assessment, Total Maximum Daily Load (TMDL) Tracking and Implementation System (ATTAINS) provide five different assessment categories in which every AU will be placed. The EPA Guidance allows the states to subdivide the federal categories to address state programmatic needs. Virginia’s 2026 assessment guidance contains the categories and subcategories Virginia has chosen for enhanced tracking and data management purposes. Virginia’s 2026 assessment guidance contains a number of changes, all enumerated in Section 1 of the guidance.

The Child & Family Services Manual Chapter D, Resource Family, is being updated to reflect legislative changes in 2023 and 2024 and to provide a re-organized and easier to utilize structure for the Local Department of Social Services. Until now, this chapter of guidance was a single section, but with these changes, the chapter has been reorganized and split into the following five sections: Resource Family Overview, Kinship Resource Family Approval, Resource Family Recruitment, Resource Family Approval, and Resource Family Support. Within the re-organization, the updates to this manual provide clearer differentiation in the approval processes for kinship and non-relative resource parents.
