Guidance Document Change: The Model Policies for the Treatment of Transgender Students in Virginia’s Public Schools guidance document was developed in response to House Bill 145 and Senate Bill 161, enacted by the 2020 Virginia General Assembly, which directed the Virginia Department of Education to develop and make available to each school board model policies concerning the treatment of transgender students in public elementary and secondary schools. These guidelines address common issues regarding transgender students in accordance with evidence-based best practices and include information, guidance, procedures, and standards relating to: compliance with applicable nondiscrimination laws; maintenance of a safe and supportive learning environment free from discrimination and harassment for all students; prevention of and response to bullying and harassment; maintenance of student records; identification of students; protection of student privacy and the confidentiality of sensitive information; enforcement of sex-based dress codes; and student participation in sex-specific school activities, events, and use of school facilities.

Emphatically Oppose
 

I strongly oppose the proposed guidelines as they have the effect of substituting the state’s temporal prerogatives over the rights of parents to raise their own children as they see fit.  Specifically, these guidelines explicitly allow unelected school administrators to withhold important information from parents regarding their children.  Furthermore, these guidelines extend beyond the school to specifically stipulate that parents could be held liable for child abuse solely for not affirming a child’s stated gender preference at any particular time.  In effect, these guidelines marginalize parents even further by usurping parents’ deeply held moral or religious convictions as they apply to how they raise their children, and even to the very essence of humanity itself.

These guidelines, presented without actual debate, do not mention minimum age of child, suggesting that they still apply even when child is too young to be aware of the importance of such a decision has on their life.  These guidelines have no rational scientific basis, rather, they rely strictly on a child’s emotional whims at any particular moment.
