The Virginia Constitution, Article 1 Section 1 states that all people in the Commonwealth have a right to live. From that extends the ability to defend ones self or others if need be. Article 1 Section 15 speaks to this further by stating that armed and trained citizens are the proper means of defense of the state -- including themselves and others. Finally, in Article V Section 7, the very first sentence says that the Governor's executive power is to take care that the laws are faithfully executed.
The legislature is clear that absent specific and clearly defined exceptions, the people of the commonwealth are within their rights to carry handguns for defense. That the regulation targets concealed carry specifically when those who do so lawfully are specifically licensed by the commonweath to do so defies logic. Further, that the regulation includes everyone and is not limited to state employees clearly contradicts the regulation's language that it is to be "consistent" with the VDHRM Policy 1.80. Thus, as I put in the subject. This regulation defies common sense, logic, the VA constitution, and exceeds the Governor's lawful authority under the constitution.
