The considered action is unlawful
 

The proposed change would violate Virginia Const. Art. II, Sec 2 and VA Code § 24.2-418.  Until this administration can convince the General Assembly to change the law, the Board of Elections does not have the statutory authority to implement this change.

We currently have numberous cases of persons being dismissed from jury duty on the basis of their non-citizen status, which would require that the potential juror had previously registered to vote.  This change would exacerbate that existing problem, tainting jury polls while increasing the frequency of non-citizens casting votes in elections.  In no way has the Board of Elections demonstrated that these certain outcomes serve the public interest in any way.
