The Constitution of Virginia §2 Registration of voters, second paragraph requires that the applicant provide information on a standard form, including “…whether the applicant is presently a United States citizen and such additional information as may be required by law.”

The Code of Virginia §24.2-418A Application for registration states that information the applicant is required to provide on the form includes “…whether the applicant presently is a United States citizen” , “and whether the applicant has ever been adjudicated incapacitated or convicted of a felony …”.

The current registration form meets the requirements of the constitution and the law. The applicable forms on the box are marked with an asterisk, indicating that they must be checked, or otherwise the application may be rejected.

The proposal to change Virginia Administrative Code 1 VAC20-40-70 by making omissions to checking Boxes 1 and 5 on the proposed new Virginia Voter Registration Form not material to the completion of the form  are inappropriate and inconsistent with the Constitution of Virginia and the Code of Virginia and should be rejected.
