| Action Summary |
The Agency will initiate a regulatory action to remove the reference to the Curriculum and Administrative Guide for Driver Education in Virginia (“the Guide”), 2010 Edition found in 8VAC20-340-40. The Guide is currently listed as a document incorporated by reference, but the need for it to be categorized in this way is negated by Code of Virginia § 22.1-205 (F). This code section requires correspondence courses for the classroom training component of driver education to be “consistent in quality with instructional programs developed by the Board for classroom training in the public schools.” By removing the reference to the Guide and amending the regulation to refer back to the relevant statutory law, the Board will ensure that the most up to date documents are being used by regulated parties. |
