Since more than 180 days have passed since the end of the NOIRA stage, a Time Frame Waiver must be granted by the Governor's office.

Agency Reason: On behalf of the Board of Education, the Department of Education submits the following request to waive the 180 day requirement to submit proposed regulations following the close of the NOIRA public comment period, pursuant to Executive Order 14 (2010). A NOIRA was filed October 1, 2012 to amend the Licensure Regulations for School Personnel [8 VAC 20 22] to establish licensure requirements for teachers who teach only online courses, pursuant to House Bill 578, passed by the General Assembly during the 2012 Session (Action 3809 / Stage 6615). The public comment period for the NOIRA ended December 19, 2012. The proposed regulations should have been submitted to DPB by June 17, 2013. The Board reviewed the recommendation of the Advisory Board on Teacher Education and Licensure to establish an online teacher license in the Licensure Regulations for School Personnel (Proposed Stage) at its meeting April 25, 2013. The proposed regulations were also shared with the Office of the Attorney General at this time. The Board approved the proposed amendments to the Licensure Regulations for School Personnel to establish an online teacher license at its meeting May 23, 2013. The final version of the proposed amendments had been shared with the Office of the Attorney General in advance of the meeting. Upon the Board approval, the proposed amendments were updated in the Town Hall system May 29, 2013. The Department and Board’s actions were in compliance with the 180 days requirements; however, the certification by the Office of the Attorney General has taken longer than expected.
