STATE WATER CONTROL BOARD
NOTICE OF PERIODIC REVIEWS


Pursuant to Executive Order Number Twenty-five (1998), the Department of Environmental Quality on behalf of the State Water Control Board, will review several regulations. The purpose of the review is to determine whether the regulations should be terminated, amended or retained in their current form. The review of the regulations will be guided by the principles listed in Executive Order Number Twenty-five (1998).

Eastern Virginia Ground Water Management Area (9 VAC 25-600-10 et seq.) The purpose of this regulation is to protect public health and/or welfare with the least possible costs and intrusiveness to the citizens and businesses of the Commonwealth; to minimize the impacts of new permitted withdrawals on pre-existing ground water users to be measured by the number of documented reports of unmitigated impacts on existing ground water users attributable to permitted withdrawals; and to preserve existing high quality ground water for future beneficial uses to be measured by the number of documented reports of ground water quality decline (specifically increases in chloride concentrations) at permitted withdrawal sites with ground water quality monitoring requirements. The department and the board are seeking public comment on the review of any issue relating to these regulations including whether (i) the regulations are effective in achieving their goals; (ii) the regulations are essential to protect the health, safety of welfare of citizens or for the economical performance of important governmental functions; (iii) there are less burdensome and less intrusive alternatives for achieving the purpose of the regulations; and (iv) the regulations are clearly written and easily understandable by the affected persons.

Comments on the above are welcome and will be accepted until February 19, 2002.
