I have reviewed the proposed regulation on a preliminary basis.  While I reserve the right to take action at a later date, I approve the advancement of this regulation to the next stage for the purpose of soliciting public comment.  I would like the Board to consider whether there is more flexibility that can be provided for the changes in the bathroom facility requirement.  One potential option, if the requirement is necessary, is to make sure there is an extended period allowed to achieve compliance with the requirement.  In addition, the regulations add requirements for broad disclosure of criminal background information.  The Board should consider whether more specific disclosure requirements can be used and still protect the public.
