Stage:
On 9/1/2015 the board requested that this
emergency stage be extended until 6/24/2016.
Reason for Extension:
The agency approved an Emergency Regulation and NOIRA in October 2013. The emergency regulation expires on December 24, 2015. The Board approved a proposed permanent replacement in December 2014. It is not anticipated that the permanent replacement will be effective prior to expiration of the emergency regulation for the following reasons: executive approval of the proposed regulation is still pending; a 60-day public comment period will be conducted following publication of the proposed regulation; Board action to approve the final regulation will be required (Board meets bimonthly); and executive review and approval of the final regulation is required prior to publication and 30-day adoption period.
This emergency extension request was approved by the Governor's office on 9/4/2015.
