Description of Proposed Guidance Document Changes
1. Guidance Document 5584: Review of ALHI Applications with Criminal Convictions. The guidance provides the processing of asbestos, lead abatement and home inspector applications where applicants indicate a previous criminal conviction. Guidance is being repealed because it will be replaced with a new document. 2. Guidance Document 5747: Requirements for Individuals who Analyze PCM Air Samples Onsite. The guidance provides that a project monitor or on-site analyst can satisfy the requirement for AIHA accreditation or PAT Program proficiency through completion of the NIOSH 582 or equivalent, and PAT Program and AIHA (AIHA-LAP, LLC) accreditation. Guidance is being repealed because it has been incorporated into regulation. 3. Guidance Document 6018: Clarification of Acceptable Degree Programs for Asbestos & Lead Licensing. The guidance provides acceptable degree programs for asbestos and lead licensing. A degree with a minimum of 40 semester credit hours in STEM (Science, Technology, Engineering, and Math) related courses is acceptable towards meeting the application requirements for licensure. Guidance is being repealed because it has been incorporated into regulation. 4. Guidance Document 6374: Renewing Asbestos Workers License with Asbestos Supervisor Refresher Training. The guidance provides that the Board will accept EPA/AHERA or Board-approved asbestos supervisor training programs for renewal of an asbestos worker license provided all other requirements of the Board are met. Guidance is being repealed because it has been incorporated into regulation. 5. Guidance Document 6834: Clarification Regarding Asbestos Abatement Projects that Require a Project Monitor. The guidance provides clarification of 18VAC15-20-455.1 regarding asbestos abatement projects that require a project monitor. Guidance is being repealed because it has been incorporated into regulation. 6. Guidance Document 7208: Verification of Course Completion Certificates Awarded to Training Program Managers and Principal Instructors. The guidance provides that course participants who are both the training manager and principal instructor of a training program must be monitored by another instructor if completing said program’s examination for the purpose of license renewal. The monitoring individual will sign the certificate of completion as the participant’s instructor. And course participants who are either the training manager or the principal instructor must be monitored by the other if completing their own program’s examination for the purpose of license renewal. The monitoring individual will sign the certificate of completion as the participant’s instructor. Guidance is being repealed because it has been incorporated into regulation. 7. Guidance Document 7209: Electronic Delivery of Asbestos and Lead Refresher Courses. The guidance provides that electronic delivery of asbestos and lead refresher training courses is permitted if certain requirements are met. These include authenticating student identity, assigning unique identifiers, tracking participation and progress, incorporating knowledge checks and a final test with an 80% passing score, and providing non-editable certificates indicating the course was taken online. Instructors must be available for support during the training, and each electronic course requires separate approval from the Board. Additionally, Board staff must have unrestricted access to audit the courses, and all other statutory and regulatory requirements for refresher courses must be met. This applies only to refresher courses, and electronic delivery includes both real-time and asynchronous formats. Guidance is being repealed because it has been incorporated into regulation.
