Amendments to Public Participation Guidelines

Chapter 795 (amendments to §§ 2.2-4007.02 and 2.2-4009 of the Code of Virginia) passed in regard to the right to counsel in rule-making proceedings, providing that in formulating any regulation or in evidentiary hearings on regulations, an interested party shall be entitled to be accompanied by and represented by counsel or other qualified representative. Chapter 599 (amendments to § 2.2-4007.04 of the Code of Virginia) passed in regard to establishing certain requirements related to notice to stakeholders and opportunity for comment when the Department of Behavioral Health and Developmental Services posts a new regulation or final stage of a regulation to the Virginia Regulatory Town Hall or proposes a change to guidance documents related to licensure requirements.
