Description This regulation establishes trout fishing opportunity and also provides for limits and special trout fishing areas that will sustain trout populations and create diverse angling opportunities. The sale of trout is prohibited except from permitted, private rearing facilities (§29.1-417) and §29.1-531 D. requires the Board to establish a system of identifying artificially raised trout sold from private facilities. Two sections of this regulation place certain requirements on private commercial trout rearing fishing facilities to protect public trout resources from commercial harvest and clarify the separation between commercially raised trout and sport harvest. This regulation is designated to maximize and diversify recreational trout angling opportunities by providing the highest quality recreational opportunity for the greatest number of trout anglers, while maintaining or increasing fishable trout populations. Sections that address size and creel limits, and methods of trout angling are specifically designed to spread harvest over a larger number of anglers and to protect wild populations from overharvest. Special trout fishing areas established in this regulation are to provide more fishing opportunity in streams that would otherwise be posted, diverse trout angling opportunities, and urban fishing opportunities. Sections pertaining to commercial trout rearing/fishing facilities are designed to establish a practical system of identifying trout offered for sale from those caught from public waters as specified in §29.1-531 D. of the Code of Virginia.
