Mandate Title:
Amend Property and Surety Bail Bondsmen Regulations to Conform to Statutory Language
Purpose of legislation
The Board is amending the regulations to conform to changes in the Code of Virginia in Chapter 600 of the 2015 Acts of the Assembly resulting from HB2314. The amendments require a bail bondsman to report any felony arrest to the Department within 10 calendar days of the arrest and reduces from 30 to 10 calendar days the time within which a bail bondsman must report changes to his or her residence or business address, is subject to disciplinary actions, and any arrests or criminal convictions. HB2314 also included a provision under professional conduct standards that prevent any bail bondsman who has been arrested for a felony from issuing any new bonds pending the outcome of an investigation by the Department of Criminal Justice Services. In incorporating this language into the regulations, the Board will also include the provisions enacted during the 2011 General Assembly regarding bail bond premiums to ensure all statutory professional conduct standards are addressed in the regulations. Lastly this action includes language to conform to statutory language regarding eligibility requirements that went into effect on July 1, 2014 pursuant to Chapter 84 Acts of Assembly (2014) as a result of HB1007 which replaced the acronym GED with "passed a high school equivalency examination approved by the Board of Education."
