Regulations Establishing Standards for Accrediting Public Schools in Virginia [8 VAC 20 ‑ 131]
Emergency Extension Request
(3746)
Action:
Update to comport with legislative changes made by HB 1061 and SB 489 (2012) (diploma requirements)
(6253)
Stage:
Emergency/NOIRA

On 4/3/2014 the board requested that this emergency stage be extended until 12/4/2014.

Reason for Extension:
The Board approved emergency regulations at its June 2012 Board meeting. The emergency regulations became effective in June 2013. The Board approved proposed permanent regulations, exactly the same as the emergency regulations, at its July 2013 Board meeting. It will be impossible for the permanent regulations to move through the remainder of the APA process before the emergency regulations expire. If the emergency regulations are not extended and the permanent regulations not adopted, graduation requirements will revert back to the 2012 requirements. This will result in confusion for school divisions and families, a lowering of graduation requirements, and denial of certain students with disabilities to earn a Standard Diploma. If special education students are not able to earn a Standard Diploma via the accommodations approved by the Board, as authorized in the Code, parents and special education advocacy groups will be outraged.

This emergency extension request was approved by the Governor's office on 5/28/2014.
